1 Acceptance of Terms

By downloading, installing or using the SiteRescue application ("the App"), you fully accept these Terms and Conditions of Use ("Terms"). If you do not accept these Terms, you must immediately uninstall the App and cease using it.

Use of the App also implies acceptance of the SiteRescue Privacy Policy, which forms an integral part of these Terms.

You must be at least 13 years old to use the App.

2 Description of Service

SiteRescue is a mobile application for emergency backup of websites hosted on remote servers. The App allows you to:

  • Connect to remote servers via FTP and SFTP protocols
  • Export website files in compressed format
  • Export databases (MySQL, MariaDB, PostgreSQL, SQLite)
  • Save backups locally on the device or to cloud services (Google Drive, OneDrive, iCloud)

2.1 Nature of the Service

SiteRescue is a manual and emergency backup tool. The service:

  • Does not perform scheduled automatic backups — every operation must be manually initiated by the user
  • Does not store website data on its own servers — data travels directly between the user's remote server and the selected device/cloud
  • Does not guarantee continuous availability of third-party servers (Google Drive, OneDrive, iCloud) integrated in the App
  • Does not replace a professional and continuous backup strategy

2.2 CMS Compatibility

The App supports the following CMS: WordPress, Joomla, Drupal, PrestaShop, Magento. Support is provided to the extent that the server configuration allows and does not imply any guarantee of compatibility with all versions, configurations or customisations of these CMS platforms.

3 Limitations & Technical Requirements

3.1 Server-side requirements (user's responsibility)

The correct operation of the App depends on the configuration of the user's remote server. The user is solely responsible for:

  • Write permissions on the website directory — required for backup operations
  • Available disk space on the server for temporary files created during backup
  • FTP/SFTP access with valid credentials and necessary permissions
  • Server availability and reachability during the backup operation
  • Firewall and port configuration on the server

The App cannot function correctly without these requirements. The provider is not responsible for backup failures caused by missing technical requirements or unsuitable server configurations.

3.2 User's device

The user is responsible for:

  • Keeping the device on and connected to the internet throughout the backup
  • Not switching to other apps during critical operations (the Android foreground service reduces but does not eliminate the risk)
  • Having sufficient space on the device for the final backup file download

3.3 Third-party services

The App integrates with third-party services (Google Drive, OneDrive, iCloud, Google Play). The provider is not responsible for interruptions, changes or discontinuation of such services, nor for their usage policies, privacy or terms of use.

4 Subscription Plans & Pricing

4.1 Free Plan

The free plan includes limited features (unlimited sites, 1 backup per month, files or database only, local download only). The Free plan is subject to change at any time, including reduction or removal of free features, with reasonable prior notice.

4.2 Emergency Pass

The Emergency Pass is a one-time consumable purchase that unlocks extended features for a period of 24 hours from the moment of purchase. Key characteristics:

  • The 24-hour countdown starts immediately upon purchase completion
  • Not automatically renewable — each use requires a new purchase
  • Cannot be paused, interrupted or postponed once activated
  • Not transferable to other users or devices

4.3 Recurring Subscriptions

The Basic, Pro and Agency plans are recurring subscriptions (monthly or annual) with automatic renewal via Google Play Store. Key characteristics:

  • Renewal occurs automatically at the end of each billing period
  • The user may cancel automatic renewal at any time via Google Play settings
  • Cancellation of subscription does not entail a refund for the period already paid — access remains active until the end of the current period
  • The provider reserves the right to change prices with a minimum notice of 30 days, in accordance with Google Play policy

4.4 Usage limits

Plan limits (number of sites, number of monthly backups) are verified and enforced at the app level. The provider reserves the right to modify these limits, with notification to users via app update or in-app notification.

5 Payments & Billing

5.1 Payment platform

All payments are processed exclusively via Google Play Store (Android) or Apple App Store (iOS), according to their respective billing policies. The provider does not directly handle user payment data.

5.2 Currency and conversion

Prices are expressed in US Dollars (USD). Conversion to local currency is handled automatically by Google Play / Apple App Store. The provider is not responsible for any differences due to exchange rates or bank fees.

5.3 Taxes and VAT

Applicable taxes (VAT and others) are calculated and managed by Google Play / Apple App Store as merchant of record, according to the tax legislation applicable in the user's country.

6 Refund Policy

6.1 General rule

Refunds are handled in accordance with the refund policies of Google Play Store and Apple App Store. The provider does not process direct refunds outside these platforms.

6.2 Emergency Pass

The Emergency Pass, as a consumable product with immediate activation, is not refundable once the 24-hour period has started. Any refunds for documented technical malfunction may be requested via Google Play, according to the relevant policy.

6.3 Subscriptions

For recurring subscriptions, any refunds are subject to Google Play / Apple App Store policies. In general:

  • Annual subscriptions may be refunded within 48 hours of purchase via Google Play
  • Subsequent periods are not automatically refundable

6.4 Malfunctions

In the event of a documented App malfunction attributable exclusively to the provider (not to network, server or user's device issues), the provider will evaluate on a case-by-case basis the possibility of compensation, which may consist of an extension of the subscription period or a partial refund via Google Play.

7 Limitation of Liability

7.1 General exclusion

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the provider is not responsible for:

  • Loss of website or database data, even when using the App
  • Incomplete, corrupted or unusable backups due to server configurations, network interruptions, insufficient disk space or other factors external to the App
  • Direct or indirect damages arising from the inability to complete an emergency backup
  • Loss of business opportunities, revenue or profits resulting from failed or incomplete backups
  • Damage to the remote server arising from use of the App, including errors in access permissions
  • Data deleted or overwritten on the remote server during temporary file cleanup operations
  • Malfunctions of third-party services (Google Drive, OneDrive, iCloud, Google Play) integrated in the App

7.2 Liability cap

In any case, the provider's maximum liability to the user shall not exceed the value of the subscription paid in the last 12 months (or the value of the last Emergency Pass purchased, if applicable).

7.3 Auxiliary tool

SiteRescue is designed as an auxiliary emergency tool and must not be considered the sole backup solution for critical data. The provider strongly recommends using professional and automated backup solutions in addition to SiteRescue.

8 Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to:

  • Warranties of fitness for a particular purpose
  • Warranties of freedom from errors or service interruptions
  • Warranties that backups produced are complete, accurate or restorable
  • Warranties of compatibility with all server configurations, CMS or database versions
  • Warranties of continuous availability of the App or integrated services

The provider commits to keeping the App operational and updated but does not guarantee uninterrupted service availability.

9 User Obligations

The user agrees to:

  • Use the App exclusively for lawful purposes and in accordance with these Terms
  • Perform backups only of websites they own or for which they have explicit written authorisation from the owner
  • Not use the App to access third-party servers without authorisation
  • Not attempt reverse engineering, decompilation or modification of the App or its components
  • Not share their Google Play account credentials with third parties
  • Provide correct and personal server credentials — the provider is not responsible for unauthorised use resulting from credentials entered by the user
  • Not use the App for illegal purposes, including unauthorised access to third-party computer systems

9.1 Professional use

If the user uses the App in the context of professional activity (e.g. managing client websites), the user is solely responsible for obtaining the necessary authorisations from their clients before performing backup operations on their servers.

10 Intellectual Property

10.1 Provider's rights

The App, its source code, design, logo, name "SiteRescue", graphics and all related content are the exclusive property of the provider and are protected by applicable copyright, trademark and intellectual property laws.

10.2 Licence of use

The provider grants the user a personal, non-exclusive, non-transferable and revocable licence to use the App for personal or professional purposes, within the limits of the subscribed plan and in accordance with these Terms.

10.3 Prohibitions

It is prohibited to:

  • Copy, modify, distribute or sell the App or parts thereof
  • Create derivative works based on the App
  • Remove or alter copyright or intellectual property notices
  • Use the name "SiteRescue" or the provider's logo without written authorisation

11 Suspension & Termination

11.1 Termination by the user

The user may terminate use of the App at any time by uninstalling it. For active subscriptions, uninstalling does not automatically cancel the subscription, which must be managed via Google Play Store.

11.2 Suspension by the provider

The provider reserves the right to suspend or terminate access to the App in case of:

  • Violation of these Terms
  • Fraudulent or abusive use of the App
  • Illegal activities or activities that cause harm to third parties

In case of suspension for Terms violation, no refund of the remaining period is provided.

11.3 Service discontinuation

The provider reserves the right to permanently discontinue the service with a minimum notice of 90 days, during which:

  • Users with an active subscription will retain full access until natural expiry
  • Subscriptions will not be automatically renewed
  • Users with annual subscriptions may request a pro-rata refund for unused months

12 Changes to Terms

The provider reserves the right to modify these Terms at any time. Changes will be communicated via:

  • In-app notification on first launch following the change
  • Update of the "Last updated" date at the top of this document

Continued use of the App after communication of changes constitutes acceptance of the new Terms. If the user does not accept the changes, they must cease using the App and, if applicable, cancel their subscription.

13 Privacy & Data Processing

The processing of users' personal data is governed by the SiteRescue Privacy Policy, which forms an integral part of these Terms.

In summary:

  • The App does not collect users' website data on its own servers
  • Server credentials entered by the user are used exclusively to connect to the remote server and are not transmitted to the provider
  • In-app purchases and subscription management are handled by RevenueCat, which receives validation data from Google Play; no backup data or credentials are involved
  • No analytics or crash reporting data is collected

14 Governing Law & Jurisdiction

14.1 Governing law

These Terms are governed by and interpreted in accordance with Italian law, without regard to conflict of law principles.

14.2 Jurisdiction

For any dispute relating to these Terms or use of the App, the exclusively competent court is that of the place of residence or domicile of the provider, unless otherwise required by mandatory applicable law for consumers.

14.3 Alternative dispute resolution (ADR)

In accordance with EU Regulation 524/2013, consumers residing in the European Union may use the European Commission's ODR (Online Dispute Resolution) platform for out-of-court resolution of disputes: ec.europa.eu/consumers/odr

14.4 Consumer users

These Terms do not affect the non-derogable rights granted to consumers by applicable law in the user's country of residence, including EU consumer protection directives.
